Brazil: Digital Employment Workbook updates

The Special Secretary of the Ministry of Economy has published decree number 1065 (Sept. 23, 2019) formalizing the Digital Employment Workbook (DEW). The DEW is an App for Android and iPhone (iOS), CTPS (Carteira de Trabalho Digital) that provides employment contract and personal information. It replaces the physical document.

Impact

The DEW can be issued to those registered with a CPF number (Brazilian personal tax payer number). This DEW document is only accepted for companies that use e-Social, an employer platform where employment information is provided to the government.

Only the employee has access to DEW since it is related to previous and current employment contract.

Looking ahead

Benefits of the DEW include employee access to:

  • Consolidated labor information in a single environment
  • Enabling workers to monitor their employment history
  • Annual leave
  • Mandatory social contribution.

Physical attendance at the agency is no longer required to issue it.

The App (CTPS Digital) can be downloaded for free (Apple’s App Store and Android Play Store). Further details are available on the Ministry of Labor website (only available in Portuguese).

Brazil: Investors new residence authorization rules

The Ministry of Justice and Public Safety, through the National Immigration Council, published new residence authorization rules for investors through normative resolution 37.

Impact

The normative number 37 guarantees the immigrant investor in Brazil the right to transform a temporary visiting visa for an indefinite period, post-arrival.

Looking ahead

All personal documents must be apostilled before arrival in Brazil. Attention will be given to the validity of criminal records. A sworn translator in Brazil is required to translate in Portuguese.

Nigeria: E-registration program for foreign nationals

The e-registration process for foreign nationals who are resident in Lagos has now commenced.

Impact

Foreign nationals who are aged 18 and older and intend to stay in Nigeria for more than 90 days must visit an e-registration center. They will be required to provide relevant documentation and information to complete an online registration form and have their biometrics taken. The documents that foreign nationals are required to provide may vary depending on their nationality and the type of visa they hold.

The Migrants e-registration scheme has a web-based pre-registration option – a self-service process for migrants to complete preliminary registration.

Looking ahead

The migrant e-registration data form must be obtained from an e-registration center to initiate the registration process as the portal is not yet functional.

Employers are encouraged to work with employees to ensure they are registered correctly and at the appropriate registration center. Failure to register could result in penalties (500,000 Naira/US$ 1,390 and/or up to three years in prison).

Russia: Moscow migration office issue invitation letters in electronic format only

The Internal Affairs Ministry Moscow office will now issue all invitation letters electronically and require payment certificates with the application.

Impact

Corrections to the foreign national’s name or place of birth will only be permitted where officials of the Internal Affairs Ministry have made mistakes. Amendments are estimated to take up to one or two business days.

Looking ahead

Corrections relating to travel dates as well as the Russian consulate (where the application will be filed) will not be permitted. Only the Russian consulate mentioned in the invitation letter can issue the visa.

South Africa: ICT visa requirements

A company-drafted skill transfer plan forms part of an Intra-Company Transfer (ICT) visa application. Until now, the law has not required either an employer or ICT visa holder to provide that documentation or advise on the progress of the skills transfer to the Department of Home Affairs (DHA) or any other department.

Impact South Africa

A number of South African missions have begun to request proof that an ICT visa holder has transferred skills to a nominated South African understudy. However, no official announcement of this change has been issued.

Looking ahead

To ensure compliance with this requirement, it is advised that employers record and maintain evidence of any ICT visa holders leading training sessions, as well as regular reports on the transfer of skills.
